Definitions

• "Agreement" means these Terms & Conditions together with any engagement letter or service confirmation issued by Niti Siam.
• "Service" means the pension legal services offered by Niti Siam, including consultation, documentation assistance, and formal representation.
• "We / Us / Our" refers to Niti Siam, a legal practice registered and operating in Bangkok, Thailand.
• "You / User" refers to any individual who accesses our website or engages our services.
• "Content" means all text, documents, and materials made available through our website or issued as part of a service engagement.

Acceptance of Terms

By using our website or submitting an enquiry, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Formal engagement of our services constitutes acceptance of these terms in full.

If you do not accept these terms, please do not use our website or submit an enquiry.

Service Description

Niti Siam provides pension legal services in Thailand. The three service types currently offered are:

1. Pension Concern Consultation (฿4,400) — an initial meeting to assess a client's concern and explain available options, with a written overview provided afterwards.
2. Documentation & Filing Assistance (฿9,900) — preparation and submission of documents required for a pension matter.
3. Full Pension Representation (฿17,500, phase-confirmed) — comprehensive representation through a dispute or appeal, with costs agreed before each phase.

Services are available to individuals with pension concerns arising under Thai law. Geographic restrictions may apply to matters involving foreign pension arrangements.

User Responsibilities

When using our website or engaging our services, you agree to:

• Provide accurate and complete information in all enquiries and during engagements
• Not submit false, misleading, or fraudulent information
• Not use our website for any unlawful purpose
• Not attempt to gain unauthorised access to our systems
• Notify us promptly of any change in circumstances relevant to your matter

Intellectual Property

All content on this website — including text, structure, and visual elements — is the property of Niti Siam. You are granted a limited, non-exclusive, non-transferable licence to view the website for personal, non-commercial purposes.

Written materials provided to you as part of a service engagement (consultation overviews, correspondence, documents) are prepared for your use in relation to your specific matter and may not be reproduced, published, or shared without our prior written consent.

Payment Terms

Fees are as stated in the service descriptions and in any engagement letter issued. All amounts are in Thai Baht (฿).

Payment is due prior to or at the commencement of the relevant service. For Full Pension Representation, each phase is confirmed and invoiced separately before work on that phase begins.

We accept payment by bank transfer and other methods confirmed at the time of engagement. Receipts are provided on request.

Refunds: Consultation fees are non-refundable once the meeting has taken place. For documentation and representation services, fees for completed work are not refundable. Fees paid in advance for work not yet commenced may be refunded at our discretion, less any reasonable administrative costs incurred.

Service-Specific Terms

Consultation: The consultation is a standalone service. Participation does not create an ongoing legal engagement unless separately confirmed in writing.

Documentation & Filing: We are responsible for preparing documents accurately based on information provided by you. We are not responsible for delays or adverse outcomes arising from incomplete or inaccurate information supplied by the client.

Representation: Scope, timeline, and costs for each phase of a representation matter are confirmed in writing before that phase begins. The total duration of a representation engagement depends on the relevant authority's procedures and cannot be guaranteed.

Disclaimers

While we apply care and expertise to every matter, legal outcomes cannot be guaranteed. The information on our website is for general purposes only and does not constitute legal advice. Formal legal advice is provided only within a confirmed engagement.

Our website is provided "as is". We do not warrant that it will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by Thai law, Niti Siam's liability for any claim arising from the use of our website or the provision of services is limited to the fees paid by you for the specific service to which the claim relates.

We are not liable for indirect, consequential, or incidental losses, including loss of income or anticipated savings, arising from matters outside our reasonable control.

Confidentiality

All information shared with us in the course of an engagement is treated as strictly confidential. We will not disclose client information to third parties except where required by law, where disclosure is necessary to provide the service, or where you have given your written consent.

Termination

Either party may terminate a service engagement by giving written notice. On termination, you are responsible for fees relating to work completed up to the date of termination. We will provide a written account of work completed and any amounts outstanding.

Provisions relating to confidentiality, payment, and dispute resolution survive termination.

Dispute Resolution

These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from these terms or from a service engagement will first be addressed through direct negotiation between the parties.

If direct resolution is not achieved, the parties agree to seek mediation before initiating formal proceedings. Any unresolved dispute shall be subject to the jurisdiction of the courts of Bangkok, Thailand.

General Provisions

Entire agreement: These terms, together with any engagement letter, constitute the entire agreement between the parties in respect of the relevant service.

Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect.

Waiver: Failure to enforce any provision of these terms on a given occasion does not constitute a waiver of that provision.

Assignment: You may not assign your rights under these terms without our prior written consent.

Changes to These Terms

We may update these terms from time to time. The updated version will be published on this page with a revised "Last Updated" date. For ongoing engagements, material changes will be communicated to you directly. Continued use of our website following an update constitutes acceptance of the revised terms.
